There are certain conditions in the Hindu Marriage Act of 1955 that need to be met so that a couple can file a mutual consent divorce. These include:
Both parties have agreed to file for a mutual divorce jointly without any influence, fraud, or bribe.
Both parties have mutually agreed that they have a failed marriage.
Both parties do not wish to stay together.
Both parties need to live separately for one year, at least prior to filing.
